AGREEMENT TO OUR TERMS
This website https://photoshopchef.com (the “Website”) as well as all the software (the “Software”) offered on the Website is operated and developed by Patrik HORVATH (“we,” “us”, “Author”). The Website and the Software are together referred to as the “Services”.
You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of the legal terms on this document (the “Terms”, “User Agreement”). If you do not agree with all of these Terms, then you are prohibited from using the Services and you must discontinue use immediately.
Your use of the Services is also subject to our Privacy Policy, available on the Website and incorporated into these Terms by reference. We reserve the right at any time and without notice to change these Terms.
PURCHASES AND PAYMENT
When you purchase a license for the Software, you will recieve a link where you can download the Software along with an activation key for the Software or link to a page where you can copy the activation key for the Software.
You can either purchase the license directly from us using PayPal, or purchase the license from our reseller Paddle.com
Paddle.com is the Merchant of Record for our orders and the orders are processed and fullfilled by Paddle. Paddle provides customer service inquiries and handles returns. By placing an order with Paddle, you agree to Paddle Terms and Conditions

REFUNDS
Due to the nature of digital products, all sales are generally considered final. Refunds are evaluated on a case-by-case basis and may be refused. In case you encounter a problem or believe the software is not functioning as intended, we will work with you to identify and resolve the issue.
To be eligible for a refund, you must meet the following criteria:
– You have encountered a technical issue or problem that prevents you from accessing or using the product as intended.
– You have contacted our customer support team and provided a detailed description of the issue you are facing. We may require you to provide screenshots or other evidence of the issue
– You have allowed us a reasonable opportunity to address and resolve the problem.
– You submit your refund request within 14 days of the original purchase date.
While we strive to accommodate refund requests, there are certain non-refundable circumstances where refunds may not be granted. These include, but are not limited to:
– Change of mind or no longer needing the product.
– Incompatibility with your device or system due to lack of necessary hardware or software requirements.
– Failure to read the product description and specifications before making a purchase.
– Refund requests made beyond the specified timeframe.
We will refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour.

Some of our products may be marked with a “Money Back Guarantee” label. This guarantee allows you to evaluate the product for a period of 14 days from the date of purchase. If you are not satisfied with the product during this evaluation period, you are eligible for a refund.

SOFTWARE LICENSING
When purchasing a license for the Software, you may activate the Software for your personal use on two (2) devices. If the Software license is purchased to be used commercially (purchased by a company), you must purchase a license for each individual device on which the Software will be used on.
You may not sell, distribute, land, lease or rent your license, the Software, or parts of the Software to anyone. Your license does not give you ownership of the Software, by purchasing the license, the Author grants you permission to use the Software. All rights to the Software are owned by the Author.

INTELLECTUAL PROPERTY
The Services are protected by copyrights and other intellectual property and proprietary rights, and any unauthorized use of the Service violates these Terms. You agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer any of the Services. You agree not to take any action that may infringe on our Intellectual Property Rights.
WARRANTY AND LIABILITY FOR DAMAGES
You use the Software at your own risk. The Software is provided “as is” without any warranty. The Author does not warrant fitness of the Software for any purpose. The Author shall in no event be liable for any kind of damages, including but not limited to loss of profits or data, related to the Software or its use.
MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services. We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. We are not obligated to provide ongoing maintenance, support, or updates for the Services. This means that we are not required to fix any issues, provide updates, or release new versions of the Services.
